Student Searches and Seizure

STUDENT SEARCHES AND SEIZURES

School officials have the right to search students or their property if the officials have

reasonable suspicion that the student may be in possession of something that violates

school rules or endangers others. (See the Attorney General's Opinion, 70-168 from

the Kentucky Department of Education.) The purpose of searching students, their

belongings, lockers, or desks is to protect the property and safety of others and /or to

maintain the on-going educational process of the school. Students have the protection,

as do all citizens, against unreasonable search and seizure of their property. Searches will

be used when other techniques to remedy the situation have been exhausted or when there

is immediate danger to life or safety.
